Tips for Using This Template

  • Structure the CTC to optimize tax benefits for the employee (HRA, LTA, meal coupons) while maintaining statutory compliance.
  • Clearly specify whether the role is covered under the Shops & Establishment Act or the Factories Act, as leave entitlements differ.
  • The probation period clause should mention clear confirmation criteria and the consequences of non-confirmation.
  • Ensure the offer letter references the state-specific Shops and Establishment Act for working hours and leave compliance.

Frequently Asked Questions

What is the difference between CTC and in-hand salary in India?
CTC (Cost to Company) includes all components: basic salary, allowances, employer PF/ESI contributions, gratuity, and bonuses. In-hand salary is what the employee actually receives after deducting employee PF, ESI, Professional Tax, and Income Tax (TDS). In-hand is typically 65-75% of CTC.
Is a probation period mandatory in India?
Probation is not mandated by any central law but is standard practice and recognized under most state Shops & Establishment Acts. Probation typically ranges from 3-6 months and allows either party to terminate with shorter notice.
Can an offer letter be sent and signed electronically in India?
Yes, electronic offer letters and signatures are valid under the Information Technology Act, 2000. Aadhaar eSign and Digital Signature Certificates (DSC) provide the strongest legal validity. ContractClaw Sign supports IT Act compliant electronic execution.
What is the notice period requirement in India?
There is no universal statutory notice period in India. It is typically governed by the employment contract. Common practice is 30 days during probation and 60-90 days post-confirmation. The Industrial Disputes Act, 1947 requires 1 month notice for workmen in certain establishments.
