Frequently Asked Questions

Does a power of attorney need to be notarized?
Requirements vary by jurisdiction. Many jurisdictions require notarization for the POA to be legally effective, especially for real estate transactions. Even where not required, notarization adds credibility and ensures wider acceptance by banks and institutions.
What is the difference between general and specific power of attorney?
A general POA grants broad authority to act on behalf of the principal in most matters. A specific (or limited) POA grants authority only for particular transactions or time periods. Use specific POA when you need someone to handle a single transaction.
Can a power of attorney be used after the principal dies?
No. A power of attorney terminates upon the principal's death. After death, the executor or administrator of the estate handles the deceased's affairs. The agent must stop acting once they learn of the principal's death.
